Kender makes a good point. While the whole shotgun... debacle was interesting to say the least, it was also very dangerous and begging for accidents and lawsuits.
There is a fine line between realism and danger. If you want your experience to be THAT real, you might enjoy yourself more if you actually join the military. Now me personally, I'm not terribly crazy about getting blown up or otherwise seriously injured, so I think I'm fine with the level of realism we currently have.
And while it's highly likely that the next ODA game will have some kind of pyro, expect that we're going to be much more careful about how and where we launch stuff off.

I mean.. that shotgun couldn't even fit real shells, so even that's a bit different. This is shooting an explosive projectile at a player. I see that as being even more dangerous.

Ok, so whats the legality of dried pea grenades then? The fact that they explode shooting peas classifies them as a NFA Destructive Device. Having been in Law enforcement long enough AND having contacted the BATF about them, I can tell you right now that they are illegal as sin. They are classified the same as an IED, because that's exactly what they are. Back on topic, the legality of importing those would be questionable at best.

If they were to make them out of Nerf foam (or something of that matter) and use sort of like the Thunder B grenade style, CO2 explosion, would it be ok?

I don't like the idea of a large fired projectile for the same reason I don't like people throwing their knives or tomahawks. I wear gear that protects me from bb's, and when I go to a game I only expect to have bb's fired at me. I'm so tired of people trying to bring weapons that fire something other than bb's.
We had a player who decided throwing their plastic and foam tomahawk was OK. He threw it at me and it hit me in the goggles, which then knocked them sideways. My goggles were plenty snug to have stayed in place for almost 2 years worth of playing without EVER having moved before. Now because this dumb ass decided it was OK to throw things at me I had an eye exposed. Obviously I was livid and made sure to fix the situation.
Simply put, I don't think the protective gear I wear to protect myself from bb's will protect me from a relatively heavy explosive device fired from a gas powered launcher.
I don't care what rules are put in place. While playing outdoors I've been shot within engagement limits. Why should I believe I will never be shot with this grenade? Just because rules are in place doesn't mean everyone will follow them always. Accidents happen. How many times have people been shot by a 500+ sniper rifle up close on accident? How many people have had bb's embedded in their skin from hot rifles up close? Now we are trying to bring an explosive device into play? Fuck that.
If I was playing with people I trusted, maybe. Playing at a public game, hell no. I'm glad their illegal. Some 15 year old would end up maiming their friend in their back yard anyway. As soon as the public finds out an airsoft 203 can fire an explosive device I'm sure they will want it banned.
FWIW I think the device is actually really cool and wouldn't mind firing off a few myself. I just don't want them at games.

LUL @ page three.
Has anyone checked the prices out at all? They're VERY high for disposable devices so it's pretty unlikely your gonna see any of these on the field anytime soon regardless of whether they're approved or not.
That and the shipping and import bullshit is probably going to be just as much if not more trouble than the actual price of the product bringing a starter kit to $250+ ($150-60ish for a starter kit @ current conversion)

I am aware of the high price and import problems. That doesn't mean someone won't try to make something like this themselves at home. I can imagine someone taking a Madbull PB4, putting an M80 and bb's in it and bringing it to a game and not mentioning it.
I don't take safety with a LUL. There are plenty of players who are just out to plain hurt people. I get plenty of people asking "Which gun hurts the most, I want to make my friends bleed" at the store. Things like this just inspire them to make their own, which can be even more dangerous.
Give them an inch, and they will take a mile.

I get that argument 100%, but the bottom line is... 'Money Talks'. The price of these and the import hassle is going to prevent 99.9% of all players from getting their hands on these. Everyone fretting over all this definitely warrants the 'LUL' since this whole argument is indeed comical to me and several others as well.
As for the use of these while playing, I'm in the corner with the other people who would use them in a smaller or Invite/20+ type of game. These pose no more of a safety risk than the 550fps sniper rifles that are allowed at games. (In my opinion) I've had more fireworks, flashbangs, Simunitions, and other much worse doo-dads tossed or shot at me during events than I care to remember, and I would much rather participate at an Op with these 40mm's in play rather than the upped sniper rifles that are allowed to be used by the individuals I see running around with them nowadays.
All that being said, I've already contacted the manufacturer and a few Russian dealers to get some of these to try out first hand. I'm more interested in the smoke rounds rather than the HE (For lack of a better term) models. I'll be sure to let everyone know if anything ever comes to fruition.
