You definitely cannot legally own Gen 3 NODs. I believe the law specifies military grade NODs, so even gen 2+ would be illegal. I know it is possible to export some Gen 1, perhaps Gen 2 NODs because they are not military grade. I'd do some more looking into the specifics of the laws governing the exact specs for military/nonmilitary grade. I've never had to deal with that area of the law, so I can't offer many details outside of knowing there is something out there for it. Unfortunately, No. Exporting to China is actually chargeable treason, as they are considered Neutral/hostile by The U.S. government. Gen 3's, if I recall correctly must be licensed by any nonmilitary user. I'd take the safe bet and go with V2's. The V3's, I'd contact your local police force on their non-emergency line and ask. Good luck to you! The affiliation a country has with the US has no bearing on ITAR. They are just as illegal to send to Canada or Great Britain without the correct Export license. If something is ITAR, there's no shipping it outta the US without the papers. Gen 3 NODs do not have to be licensed, any one who can legally own them is allowed to as far as I know. I would not recommend contacting a police department, this is a rather niche law that they would have no experience with. Find the actual text of the law and either find a lawyer to interpret it for you, or follow it strictly and do not put yourself at risk. Thanks for the information sir. As a non-us citizen you cannot even handle an ITAR regulated night vision device or accessory while on US soil. Sucks but it is the law and it is in place for a reason. Best bet is to just steer clear of the military grade stuff in particular, to protect yourself and any potential sellers from a legal shit-storm. Civi Night vision isn't a bad option, the yukon stuff is pretty good.

Now I come up with the idea of buying russian NVG like this rusoptics.com/?module=catalog&action=viewproduct&id=27. As that's nothing related to US technology and we can buy those back in China, there shouldn't be a problem. I'll ask some law help people next Monday probably. plus: that is shipped from outside US
